DMCA & Copyright Policy

1. Respect for Copyright
wellfd respects the intellectual property rights of others and expects users of the Platform to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and respond to valid notices of alleged copyright infringement.
2. Reporting Copyright Infringement
If you believe that content available on the wellfd platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent.
3. Required Information for a DMCA Notice
To be valid, a DMCA takedown notice must include all of the following:
Identification of the copyrighted work
A description of the copyrighted work claimed to be infringed, or a representative list if multiple works are involved.
Identification of the infringing material
The URL or specific location of the allegedly infringing material on the Platform, with sufficient detail to locate it.
Your contact information
Full name, mailing address, telephone number, and email address.
Good faith statement
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
Accuracy and authority statement
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Signature
Your physical or electronic signature.
4. Our Response to Valid Notices
Upon receipt of a valid DMCA notice, wellfd may:
- Investigate the claim promptly
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the content
- Take appropriate action against repeat infringers, including account termination
5. Counter-Notification
If you believe that content you posted was removed or disabled due to mistake or misidentification, you may submit a counter-notification to our DMCA agent that includes:
- Your name, address, phone number, and email address
- Identification of the material that was removed and its prior location
- A statement, under penalty of perjury, that you have a good faith belief the material was removed by mistake or misidentification
- A statement consenting to the jurisdiction of the federal court in your district, or in the district where wellfd is located
- Your physical or electronic signature
If we receive a valid counter-notification, we may restore the material unless the original copyright claimant files a lawsuit within the time period required by law.
6. Repeat Infringers
wellfd maintains a policy of terminating accounts of users who are determined to be repeat copyright infringers, when appropriate.
7. Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation that content is infringing, or that content was removed by mistake, may be liable for damages, including costs and attorneys' fees.
8. User Content Representations
By submitting content to wellfd (including reviews, photos, or other materials), you represent and warrant that:
- You own the content or have the legal right to use it
- The content does not infringe any third-party rights
- You grant wellfd a license to use, display, reproduce, and distribute the content in connection with the Platform
